Requirements for an H-1B Visa

  1. Job Must Qualify as a Specialty Occupation

    • The job must require specialized knowledge, typically needing a bachelor's degree or higher in a specific field.
    • Examples of H-1B-eligible roles include software developers, engineers, doctors, accountants, architects, and scientists.
  2. Applicant Must Meet Educational Qualifications

    • The applicant must have the necessary academic qualifications for the job, usually a bachelor’s degree or higher.
    • In some cases, if an applicant doesn’t have a degree but has equivalent work experience, they may still qualify.
  3. Sponsorship by a US Employer

  4. Labor Condition Application (LCA)

The H-1B Visa Application Process

The application process for an H-1B visa involves several steps, primarily handled by the sponsoring employer.

Step 1: Employer Files Labor Condition Application (LCA)

  • The US employer submits the LCA to the Department of Labor.
  • The LCA certifies that the foreign worker will be paid the prevailing wage and that hiring them will not adversely affect other employees.

Step 2: Employer Submits Form I-129 Petition

  • The employer then submits Form I-129, Petition for a Nonimmigrant Worker, to the US Citizenship and Immigration Services (USCIS).
  • This petition includes details about the job, the company, and the employee’s qualifications.
  • Employers must include the approved LCA and pay the filing fees, which vary depending on company size and other factors.

Step 3: Participate in the H-1B Lottery (if Applicable)

  • Due to high demand, the H-1B visa process includes a lottery system to select applicants.
  • Each year, 85,000 H-1B visas are available: 65,000 for regular applicants and an additional 20,000 for those with a US master’s degree or higher.
  • If the applicant’s petition is selected in the lottery, USCIS continues to process the application.

Step 4: Attend the Visa Interview

  1. Work Authorization

    • The H-1B visa allows employment only with the sponsoring employer. If the visa holder changes employers, the new employer must file a new I-129 petition.
  2. Dependents

    • Spouses and unmarried children under 21 can accompany the H-1B visa holder on an H-4 dependent visa.
    • H-4 visa holders can attend school in the US, but only spouses with Employment Authorization (EAD) are eligible to work under specific circumstances.
  3. Dual Intent
